Terms of Services (Travel Wallet)

This Terms and Conditions document (the "Agreement") constitutes a legally binding contract between you (the "User") and FOCUSONE Payment Solutions Pvt. Ltd. ("the Company," "We," "Us," or "Our").
INTRODUCTION
FOCUSONE Payment Solutions Pvt. Ltd., a private limited company duly incorporated under the Companies Act, 2006 of Nepal, with its registered office at Kamaladi, Kathmandu, Nepal, is a licensed Payment Service Provider (PSP) operating under the regulations and supervision of Nepal Rastra Bank (NRB) pursuant to the Payment Systems Act, 2074. The Company owns and operates the MOCO Travel Wallet ("MOCO" or "the Service") available on Android and iOS platforms.
By registering, or using MOCO, you agree to comply with these Terms and Conditions, our Privacy Policy, and applicable laws and regulations of Nepal.
DEFINITIONS Agreement:
This document, the Privacy Policy, and any other rules or policies published by the Company.
- App: The MOCO Travel Wallet mobile application.
- AML: Anti-Money Laundering / Countering the Financing of Terrorism
- Card(s): Valid debit or credit cards issued by licensed financial institutions, added to MOCO.
- CVV: Card Verification Value
- KYC (Know Your Customer): Identity verification process in compliance with NRB directives, requiring government-issued identification (Passport and Aadhar Card to Indian citizens).
- Merchant: Legally registered businesses in Nepal accepting MOCO payments.
- MOCO: The travel digital wallet operated by FOCUSONE Payment Solutions Pvt. Ltd.
- MPIN: Mobile Personal Identification Number set by the User for secure authentication.
- NRB: Nepal Rastra Bank, the central bank of Nepal.
- OTP: One-Time Password sent for authentication.
- Registered User: A user who has completed and verified KYC.
- Transaction: Payment made by a User via MOCO.
- User: Any individual accessing or using MOCO.
- Visitor: An individual who downloads MOCO but has not completed registration.
ELIGIBILITY AND ACCOUNT REGISTRATION
- Eligibility:
Users must be at least sixteen (16) years of age and possess valid government-issued identification. Foreign nationals must comply with applicable regulatory provisions.
- User Roles:
Registered User: Full access upon successful KYC.
- Registration and KYC:
Users must provide accurate information. The Company reserves the right to verify information and suspend accounts with false or fraudulent details.
- Card Addition:
MOCO operates a direct card-adding model with no stored wallet balance. Registered Users must add at least one Card. Cards must be legally owned by the User.
PAYMENTS, REFUNDS, AND FOREIGN CURRENCY
- Payment Process:
Payments are processed via "Scan and Pay" or in-app transactions. Authentication is required via PIN or biometrics.
- Foreign Currency Transactions:

Permitted as per NRB’s foreign exchange regulations.

The Company may levy an international card fee, disclosed prior to payment.

- Refunds and Cancellations:
All Transactions are final. Any other dispute shall be resolved in accordance with the guidelines and procedures of the respective payment scheme. Users agree to follow the applicable scheme rules and cooperate in the resolution process. The Company may decline involvement in a refund in case of fraud or abuse.
SECURITY AND DATA HANDLING

User Obligations:
Users are responsible for their credentials. Any transaction authenticated with user credentials is deemed authorized.

Company Security Framework:
Authentication: Multi-layered security with PIN, OTP, and biometrics.
Encryption: End-to-end encryption for data in transit.
Compliance:
- Adherence to PCI DSS 4 standards.
- No storage of CVV.
Password Reset: Only via secure OTP and email.

Data Collection and Privacy:

Data is collected in accordance with Nepal’s Privacy Act, 2018.

Required information includes name, location (with consent), and KYC details.

Data may be shared with NRB and other authorities as required under the Privacy Act, 2018, NRB Directives for Payment Service Providers, and applicable AML/CFT regulations.

- Response Time:
We aim to provide an immediate response.
- Dispute Escalation:
All disputes are handled in accordance with the respective scheme’s dispute guidelines. Financial disputes escalate to the issuing and acquiring banks. If unresolved, users may seek further assistance as per the scheme’s procedures.
INTELLECTUAL PROPERTY
All content, trademarks, designs, and software within MOCO are the exclusive property of FOCUSONE. Unauthorized use is prohibited and actionable under the Nepal Copyright Act, 2002.
THIRD-PARTY SERVICES AND ADVERTISING
- Advertising:
Promotional content may be shown. Users may manage notification preferences.
- Third-Party Integrations:
The Company is not liable for services offered by third parties integrated with MOCO.
TERMINATION AND ACCOUNT CLOSURE
- Closure by User:
Users may request account closure after removing all added Cards.
- Suspension by Company:
We may suspend accounts for:

Breach of Agreement.

Suspected fraud or illegal activity.

Inactivity over eighteen (18) months.

Regulatory directive.

- Investigation Holds:
Accounts under investigation cannot be closed until resolved.
DISCLAIMERS, INDEMNITY, AND LIMITATION OF LIABILITY
- Disclaimer:
Service is provided "AS IS." We do not guarantee uninterrupted service.
- Indemnity:
Users indemnify the Company from liabilities arising from misuse or breach.
- Limitation of Liability:
Liability is limited to the extent permitted by the Nepal Consumer Protection Act, 2018.
GENERAL PROVISIONS
- Governing Law:
The laws of Nepal shall govern this Agreement and the relationship between you and FOCUSONE Payment Solutions, as well as all transactions on the services.
- Amendments:
The Company may amend terms with reasonable notice. Continued use constitutes acceptance.
- Communication:
Notices will be sent electronically.
- Maintenance and Updates:
Users must install updates for secure app usage.
- Rewards and Promotions:
Governed by separate terms, subject to change.
- No Agency:
This Agreement does not create a partnership or agency relationship.
- Entire Agreement:
This document and the Privacy Policy constitute the entire agreement between the User and the Company.
